An appeal is filed in a higher court to challenge the judgment, or other appealable order, of a lower court. On appeal, a lawyer either prosecutes an appeal by making legal arguments that the judgment should be reversed or defends against the appeal by making legal arguments that the judgment should be upheld. Mr. Alger has been certified as an appellate law specialist by the State Bar of California Board of Legal Specialization. He can take the necessary steps to stay the execution of a judgment while a decision is being made whether to appeal or while an appeal is pending. He can take the necessary steps to make sure that an adequate record is obtained for an appeal. Mr. Alger can write persuasive briefs setting forth the client’s position—addressing both whether the trial court committed an error and whether there was the requisite prejudice to warrant relief.

Oral Arguments

Mr. Alger has given approximately 100 oral arguments. He has argued before the California Supreme Court on three different occasions. Therefore, he has the experience and the knowledge to make an effective oral argument.

Higher Court Review

If the Court of Appeal’s ruling is adverse, Mr. Alger has the experience and the knowledge necessary to petition the California Supreme Court for review. He has previously obtained review from the California Supreme Court.

Writ Petitions

Mr. Alger also has experience filing writ petitions, including petitions for writs of mandamus and habeas corpus. He has previously been successful in obtaining writ relief.
